In lieu of the recent infant deaths due to defective hardware on baby cribs, the U.S. Government has passed a new law requiring all child care facilities and hotels to replace all baby cribs in a 24 month period from December 10th, 2010. The law was derived from massive recalls of mostly drop-side cribs that stemmed from 32 infant deaths caused by faulty hardware. With the new law in place, manufacturers have gone through an extensive process of making new products that meet the new standards. Drop-side cribs were not the only cribs affected. Almost every crib required some sort of change to the existing hardware.
Although there is a 24 month period that gives child care providers and hotels a chance to come up with working capital to make the buy, that doesn't necessarily mean what it indicates. Say that a child care facility has the cash flow to afford replacement, and waits 24 months to replace cribs as the law states. What if an infant death occurs in a crib that has faulty hardware and doesn't meet the new standard? A person would think that they could use the law to free themselves of liability. But that is not how the court system works. The court would probably look at the cash flow situation and ask the question, why didn't they make a buy to replace the cribs that they knew were not safe, especially when they has ample time and cash to do so?
Crib And Changer
So, child care facilities and hotels, who are responsible for the safety of other people's children, should take note when considering how to handle this change in the law. The right decision may be to do what is right for the child and parents and replace the cribs as soon as possible to limit the chance of liability.
Safety is a strange science. People take chances all the time. Sometimes nothing happens, but sometimes things can get out of control by assuming the risk of the careless decisions we make. Taking the safest course of action, when funds are available, can save money fighting a lawsuit that wouldn't have happened if the right decision was made to start with. Safety is always first, especially when babies are involved. They cannot be blamed for our decisions. They need to be watched over, cared for, and protected. Most of all, we need to be good decision makers.
